Ferrellgas Trade Ally Referral Program Terms & Conditions
1. Eligibility
The Trade Ally Referral Program (the "Program") is open to any business or organization that, in the ordinary course of its operations, has contact with homeowners, property owners, businesses, or other prospective propane customers and is in a position to recommend Ferrellgas. Eligible businesses include, but are not limited to, HVAC contractors, plumbers, electricians, builders and general contractors, remodelers, pool builders and installers, landscape designers, generator sales and service companies, appliance and hearth retailers, real estate agents and brokers, property managers, insurance agents, agricultural and farm suppliers, and other local businesses ("Trade Allies"). The categories listed above are illustrative only and not exhaustive. Ferrellgas may approve or decline any enrollment at its sole discretion. Participants must be at least 18 years of age and must enroll through the Ferrellgas Trade Ally referral portal (the "Ambassador Portal"). Ferrellgas employees are excluded from participation. Self-referrals, and referrals of a Trade Ally's own accounts or affiliated entities, are not permitted.
2. Acceptance of Terms
By enrolling in the Program through the Ambassador Portal, a Trade Ally acknowledges that it has read, understands, and agrees to be bound by these Terms & Conditions, as may be updated from time to time. If a Trade Ally does not agree to these Terms & Conditions, it should not enroll in or otherwise participate in the Program.
3. How the Program Works
Trade Allies ("Referrers") may refer prospective new propane customers ("Referees") by sharing a unique referral link or code provided through the Ambassador Portal via text, email, social media, or co-branded materials made available in the portal. A referral is considered successful only when the Referee completes the qualifying action outlined in Section 4.
4. Qualifying Referrals
A referral will be deemed valid if:
The Referee is a new customer who has not previously had an account or completed a transaction with Ferrellgas.
The Referee completes the required qualifying action of receiving their first propane delivery that meets Ferrellgas's minimum fill requirements, provided such delivery occurs within 180 days following the date of the referral.
5. Rewards
Upon a valid referral:
The Referrer will receive a $50 digital gift card, issued via Tango, redeemable at hundreds of popular retailers.
There is no limit to the number of successful referrals a Trade Ally may submit or the number of rewards a Trade Ally may earn.
Rewards are subject to verification and final approval by Ferrellgas. Rewards have no cash value and are non-transferable.
6. Reward Fulfillment
Rewards endeavor to issue via email within approximately seven (7) business days after the referral has been validated and the Referee's qualifying delivery is confirmed. Referrers can track the status of their referrals in real time through the Ambassador Portal. Ferrellgas is not responsible for delays caused by incorrect account or contact details, or by third-party vendors, including Tango or Ambassador.
7. Relationship of the Parties
Participation in the Program does not create an employment, agency, partnership, joint venture, or franchise relationship between Ferrellgas and any Trade Ally. Trade Allies act solely as independent participants in the Program and have no authority to make representations, commitments, or agreements on behalf of Ferrellgas, or to bind Ferrellgas in any way. Trade Allies shall not represent themselves as employees, agents, or authorized representatives of Ferrellgas.
Participation in the Program does not constitute an endorsement, recommendation, certification, approval, warranty, or guarantee by Ferrellgas of any Trade Ally, or of the quality, safety, workmanship, licensing, pricing, or performance of any Trade Ally's products or services. Ferrellgas does not vet, verify, or monitor the licensing, insurance, or work of Trade Allies. Trade Allies shall not state or imply that they are endorsed, certified, approved, preferred, or recommended by Ferrellgas. Any transaction between a customer and a Trade Ally is solely between those parties, and Ferrellgas assumes no liability arising from goods or services provided by a Trade Ally.
8. Trademarks, Branding, and Marketing Materials
Ferrellgas may make co-branded fliers, banners, signs, and other marketing materials available to Trade Allies through the Ambassador Portal for use solely in connection with the Program. Trade Allies may use Ferrellgas's name, logos, and provided materials only as furnished by Ferrellgas and only for the duration of their participation in the Program, and may not alter, modify, or use them in any misleading, deceptive, or unauthorized manner.
Trade Allies may recommend and refer Ferrellgas products and services to their customers but are not authorized to sell, resell, or offer Ferrellgas products or services on Ferrellgas's behalf. A Trade Ally may not use the Ferrellgas name, logos, trademarks, service marks, trade dress, or other Ferrellgas branding in any advertising, marketing, promotional, or customer-facing material it creates without Ferrellgas's prior written approval.
Ferrellgas welcomes the opportunity to support Trade Ally marketing efforts. Trade Allies may submit proposed materials to Ferrellgas for review and approval, or may request that Ferrellgas work with them to jointly develop co-branded materials. Requests should be submitted to [email protected], and Trade Allies should allow 14 business days for review. Any approval is limited to the specific material and use approved, and Ferrellgas may withdraw approval at any time.
All rights, title, and interest in Ferrellgas's trademarks, logos, and materials remain the exclusive property of Ferrellgas, and all goodwill arising from their use inures to the benefit of Ferrellgas. This license to use such materials terminates automatically upon a Trade Ally's disqualification, withdrawal, or the termination of the Program.
9. Compliance with Laws
Trade Allies are solely responsible for ensuring that their referral and marketing activities under the Program, including any text messages, emails, or social media communications, comply with all applicable federal, state, and local laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. Ferrellgas is not responsible for a Trade Ally's failure to comply with such laws.
10. Fraud, Abuse, and Disqualification
Ferrellgas reserves the right to withhold rewards or disqualify participants if it determines, at its sole discretion, that a participant has:
Engaged in fraudulent activity
Used misleading, deceptive, or spam-based referral methods
Violated any applicable laws or regulations
Attempted to manipulate or abuse the referral system
11. Taxes
Participants are solely responsible for any taxes or reporting obligations related to rewards received through the Program.
Rewards are administered and issued by Ambassador on behalf of Ferrellgas. Once the total value of rewards earned by a Trade Ally reaches $600 in a calendar year, a completed IRS Form W-9 must be on file in order for the Trade Ally to continue receiving rewards. Form W-9 and any other required tax documentation must be submitted directly through the Ambassador Portal — not to Ferrellgas — and Trade Allies are responsible for keeping that information current. Rewards will be held and no further rewards issued until the required documentation has been received and verified.
12. Indemnification
Each Trade Ally agrees to indemnify, defend, and hold harmless Ferrellgas, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to the Trade Ally's participation in the Program, including its marketing or referral activities, misuse of Ferrellgas's trademarks or materials, or breach of these Terms & Conditions.
13. No Guarantee of Continued Relationship
Enrollment in the Program, or a Trade Ally's history of successful referrals, does not guarantee any future business relationship, exclusivity, minimum volume of referrals, or continued participation in the Program.
14. Modification or Termination of the Program
Ferrellgas reserves the right to modify, suspend, or terminate the Program or these Terms & Conditions at any time without prior notice.
15. Limitation of Liability
To the fullest extent permitted by law, Ferrellgas shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with participation in the Program.
16. Privacy
Participation in the Program is subject to Ferrellgas's Privacy Policy. Personal and business data submitted through the Ambassador Portal will be processed solely for the purpose of operating the Program.
By submitting your information through the third-party form from Ambassador, you acknowledge and agree to the applicable Ambassador Terms of Use and consent to receive promotional and marketing communications from Ambassador on behalf of Ferrellgas regarding the Program. You understand that your information will be processed in accordance with Ambassador's privacy practices and that you may opt out of receiving such communications at any time by clicking the unsubscribe link included in those communications or by updating your communication preferences in the Ambassador Portal. Ambassador acts as an independent service provider with respect to such communications, and Ferrellgas does not control, and is not responsible for, Ambassador's compliance with the TCPA, the CAN-SPAM Act, or other applicable communications laws in connection with such communications.
17. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles. Each party waives any right to a jury trial and to participate in any class, collective, or representative action.
18. General Provisions
These Terms & Conditions constitute the entire agreement between Ferrellgas and each Trade Ally with respect to the Program and supersede all prior or contemporaneous understandings regarding the Program. If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. A Trade Ally may not assign or transfer its rights or obligations under the Program, including any pending or earned rewards, without Ferrellgas's prior written consent.
